Privacy Policy

Biall Sp. z o.o. makes every effort to protect the privacy of individuals using its services. In order to implement the principle of lawful, fair, and transparent processing of your personal data during your use of our services, we have adopted this document called the Privacy Policy. The Privacy Policy outlines how we safeguard your personal data and your rights.

I. DEFINITIONS

  • Seller – Biall Sp. z o.o., Barniewicka 54C, 80-299 Gdańsk, registered in the Central Register and Information on Business Activity, NIP: 6040018535, REGON: 193106935.
  • Account – a collection of resources and settings created for a User and an unlogged User within the Service. The Account is used for managing services and collecting selected information, including the user's purchase history.
  • Regulations – the Regulations for providing electronic services within the service owned by Biall Sp. z o.o.
  • GDPR – Regulation (EU) 2016/679 of the European Parliament and the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).
  • Store – the online service owned by the Seller, available at www.biall.eu, through which the Seller provides services.
  • Settings (Privacy) – the functionality of the Account that allows the User to manage the services they use, including modifying their scope and choosing preferences regarding the protection of their privacy.
  • User – an adult individual who has an Account and uses services provided through the Store.
  • Unlogged User – an adult individual using services offered by the Store that do not require account registration.
  • You, Your, Yours – the respective User or Unlogged User.

III. PURPOSES OF DATA PROCESSING AND LEGAL BASIS

  1. Information recorded during purchase transactions:
    Before completing a transaction for goods in our store, we will ask you for your first name, last name, shipping address, phone number, email address, invoice data, and payment information, such as credit card type, card number, expiration date, and CVV. In order to fulfill the contract and deliver the product to the Customer, personal data may be shared to the necessary extent with:

  • Carriers (courier and shipping companies) – for product shipment,
  • Entities providing pick-up point services,
  • Payment system operators providing services to the Store, depending on the chosen payment method,
  • Based on Article 6(1)(b) and (c) GDPR.
  1. Information automatically recorded:
    During your visit to our website, data is automatically collected, such as your IP address, the products you viewed, the domain name from which you reached us, your browser type, and your operating system, based on Article 6(1)(a) GDPR.

  2. Information recorded during registration of an account on www.biall.eu – based on Article 6(1)(b) GDPR.

  3. Receiving information about products and events via email: Name, contact data (email, first name), demographic data (country, gender) – based on Article 6(1)(a) GDPR.

  4. Receiving information regarding offers from Biall Sp. z o.o. and its partners (via email) – based on Article 6(1)(a) GDPR.

  5. Processing complaints – based on Article 6(1)(f) GDPR.

  6. Securing potential claims – based on Article 6(1)(c) and (f) GDPR.

  7. Information recorded during contact with us:
    When you contact us via the website, phone, email, or chat, you provide us with your personal data, such as your name, surname, email address, and phone number – based on Article 6(1)(b) GDPR.

  8. Additional personal data processed:
    Surveillance footage from cameras in the office building at Barniewicka 54C, Gdańsk, based on Article 6(1)(f) GDPR.

IV. RETENTION PERIOD OF DATA

  1. Information recorded during purchase transactions – for 5 years from the end of the fiscal year.

  2. Automatically recorded information (as mentioned in point III.2) – until consent is withdrawn.

  3. Information recorded during account registration on www.biall.eu – until an objection to data processing is raised or a deletion request is made.

  4. Receiving information about products and events via email: Name, contact data, and demographic data – until consent is withdrawn.

  5. Receiving information regarding offers from Biall Sp. z o.o. and partners (via email) – until consent is withdrawn.

  6. Processing complaints – for 30 days from the date of filing the complaint.

  7. Securing potential claims – until the claims are time-barred according to the Civil Code.

  8. Information recorded during contact with us:
    When you contact us via the website, phone, email, or chat, your personal data is retained until you object to data processing or request deletion.

  9. Additional personal data processed:

  • Surveillance footage from cameras in the office building at Barniewicka 54C, 80-299 Gdańsk – for up to 7 days from the date of recording.

V. RECIPIENTS OF DATA
Personal data may be disclosed to employees or collaborators of Biall Sp. z o.o., as well as entities providing support services, on the basis of commissioned services and in accordance with the data processing agreements.

VI. RIGHTS OF THE DATA SUBJECT
Under no circumstances will we sell the data collected about you to third parties. The data collected during purchase transactions will be used to complete the transaction, including processing payments and delivering your order. Your data may be shared for this purpose with payment transaction providers (e.g., credit card processors), or with a courier company for delivery purposes. These entities will not use your data for any other purpose.
Providing this data is mandatory if you wish to complete your purchase. If the User does not consent to providing personal data, it is not possible to complete the order and conclude the contract.

In the event of a violation of our website’s Regulations, the law, or when required by law, we may disclose your data to law enforcement authorities. Users have the right to access and edit their personal data at any time. To exercise this right, please contact Biall Sp. z o.o.

Additionally, Users have the right to request information about the content of stored data. They are also entitled to make changes or request the deletion of their data or cessation of its use within a specified scope.

To the extent that your data is processed for the purpose of concluding and performing the contract or is processed based on consent, you also have the right to data portability. This means that you can request your personal data from the administrator in a structured, commonly used, machine-readable format. You can transfer this data to another data controller.

You also have the right to lodge a complaint with the supervisory authority responsible for personal data protection.

VII. COOKIE POLICY
Cookies are text files saved by your web browser on the hard drive of your computer or another device to store information used for your identification or to remember your activity history within the Store.

We use cookies with different lifecycles and from different domains.

Depending on their lifecycle, cookies are divided into:

  • Session cookies – deleted when the web browser is closed,
  • Persistent cookies – deleted after a predefined time, regardless of whether the web browser is closed.

Depending on the domain from which they come, cookies are divided into:

  • Own cookies – set by our Store's web servers,
  • Third-party cookies – set by web servers of sites other than our Store.

3. Purposes of using cookies

  • Providing the requested services: Our own cookies are used to enable login to your Account, access services restricted to logged-in Users, and ensure smooth navigation on the pages and subpages of the Store without repeatedly logging in.
  • Optimizing use of the Store: We use our cookies to enhance your experience by reducing the number of notifications (e.g., about updates to the regulations or cookies usage). We also use cookies to ensure the security of the IT system and to remember preferences.
  • Page visit statistics: We use third-party cookies (e.g., Google Analytics, Tawk.to) to count visits to the Store, their duration, and determine which features were most used or visited. This information helps us analyze Store performance and determine directions for developing new features and services.
  • Tracking activity in the Store: We use our own cookies to identify your activity in the Services, including which job offers you viewed and applied for. This helps us better tailor job recommendations and marketing messages to your preferences.

VIII. WHEN DOES GDPR APPLY?
On April 27, 2016, the European Parliament adopted a regulation amending the law on personal data protection. All EU countries, including Poland, must align their laws with the new regulations, which will be directly applicable from May 25, 2018.
The new regulations will be directly applicable, meaning they will not require national implementation (adoption) regardless of the current law of August 29, 1997, on personal data protection, which will be entirely amended to comply with GDPR.

IX. CHANGES TO THE PRIVACY POLICY
We may change or update the Privacy Policy as needed. We will inform you of any changes or updates by posting appropriate information on the main pages of our Services, and for significant changes, we may also send separate notifications to the email address you have provided.
The Privacy Policy does not limit any rights granted to you under the Regulations and applicable laws.
