§ 1 General provisions

These Regulations set out the rules of operation of the Online Store owned by BIALL Sp. z o.o. with its registered office in Gdańsk, including the rules for placing Orders by Customers.

Definitions used in the Regulations

  • Seller / Vendor – BIALL Sp. z o.o. with its registered office in Gdańsk, ul. Barniewicka 54C, entered in the Register of Entrepreneurs of the National Court Register under KRS 0000223476, NIP 604‑001‑85‑35, REGON 193106935, share capital PLN 50,000 fully paid‑up.
  • Customer – (i) a natural person with full legal capacity aged 18 or over, or (ii) a legal person, or (iii) an organisational unit without legal personality if, under separate regulations, it has legal capacity.
  • Online Store – the store run by the Seller at www.biall.eu.
  • Product / Goods – items offered for retail sale in the Store, brand‑new, free from physical and legal defects, lawfully introduced to the Polish market.
  • Product Price – price displayed on the Store’s website when the Product is available; expressed in Polish zloty, shown net and gross (incl. VAT). The price does not include Delivery Costs.
  • Delivery Costs – costs connected with transporting the Product to the Place of Delivery.
  • Carrier – a courier company cooperating with the Seller or Poczta Polska (for parcels not exceeding PLN 500 gross).
  • Order – a Product order placed by the Customer in accordance with the Regulations; constitutes an offer to purchase.
  • Place of Delivery – address indicated by the Customer in the Order within the territory of Poland. Delivery outside Poland is possible under terms individually agreed with the Customer.
  • Product availability is updated seven days a week from 7:30 to 8:00. Information on the Store’s site is an invitation to make offers and does not constitute an offer within the meaning of the Civil Code.
  • The Customer’s computer and software should meet the following requirements: a computer running an operating system that allows an internet browser and has internet access.
  • Sales Department / Customer Service Office – +48 58 322 11 91, Monday–Friday 8:00‑16:00, excluding public holidays. E‑mail support is provided at the same times.

The terms of each sales agreement are defined by these Regulations, the applicable law and any individual arrangements between Seller and Customer.

§ 2 Placing Orders

The Customer may place an Order using one of the following options:

  1. via the Store website: www.biall.eu
  2. by e‑mail sent to the Seller’s address
  3. by phone: +48 58 322 11 91*

Placing an Order via the website requires: completing the registration form (creating an account), selecting desired Products (adding to “cart”) and accepting the Regulations.

Registration is one‑time. Subsequent Orders can be placed using the previously registered login and password. The login and password are confidential; the Customer is liable for damage caused by disclosing them to third parties. After logging in, the Customer may update their data.

E‑mail or phone Orders must include: Customer’s full name, residence address, delivery address, product name, catalogue number, quantity, payment method; businesses must also provide company name, registered address and tax ID (NIP).

Ordering via website or e‑mail is available 24/7.

Placing an Order does not equal concluding a sales contract.


§ 3 Conclusion of the sales contract

After the Order is placed the Customer receives an e‑mail confirmation specifying: product name, product number, quantity, unit price, delivery cost, delivery method, total amount payable, place of delivery.

All Orders placed by 12:00 are processed the same business day; Orders placed after 12:00 are processed on the next business day.


§ 4 Delivery times

If the item is in stock, Order processing takes up to 5 business days (excluding Saturdays).

The delivery time is counted from the date the Order is accepted for processing.

If a Product is unavailable, the delivery time is agreed individually with the Customer.


§ 5 Delivery of Goods – delivery charges

Deliveries are carried out via the Carrier.

Charges depend on parcel weight and chosen payment method.

Orders over PLN 1,000 gross delivered within Poland are shipped free of charge via GLS courier.

Otherwise the Buyer pays according to the table:

Note: If total weight ≤ 30 kg but parcel dimensions require multiple packages, the Buyer pays for each parcel as above.

If a parcel shows external damage on delivery, the Customer should refuse it, request that the Carrier draw up a damage protocol, and notify the Seller within 2 days, providing all information necessary to pursue the Carrier’s liability.


§ 6 Payments

The Customer may choose:

  • Cash on delivery – payment to the Carrier on receipt.
  • Bank transfer / pre‑payment – within 14 days of placing the Order.

For bank transfers, include Customer name and Order number in the title. Pay to:

§ 7 Consumer’s withdrawal – returns

For in‑store purchases, the Seller is not obliged to accept returns of non‑defective goods.

For distance purchases (online) the Consumer may withdraw from the contract within 14 days of receiving the Product (Consumer Rights Act 30 May 2014). The declaration sent before expiry meets the deadline. The Consumer must return the goods within 14 days thereafter and bears direct return costs (Art. 34 § 2).

Upon withdrawal both parties must return what they received.

§ 8 Warranty for defects (statutory warranty)

The Seller is liable to the Consumer for physical or legal defects for 2 years from delivery (materials such as filters, fuses, batteries etc. are excluded).

The Consumer may demand repair, replacement, price reduction or contract rescission. The Seller may negotiate and propose a better solution.

Liability is excluded if the Consumer knew of the defect at purchase (e.g., discounted goods). Complaints can be filed by e‑mail or in writing and must include proof of purchase (receipt, witness statement, bank printout, e‑mail, etc.). The Seller will respond within 14 days; failure to do so means the complaint is accepted.

Repair or replacement – Seller acts within 14 days of delivery of the item to BIALL, at Seller’s cost.

Price reduction or rescission – possible if the defect is material and specified amount of reduction is indicated. Conditions detailed in the Polish text are preserved.

Shipping costs are borne by the Seller.


§ 9 Commercial warranty

Unless the warranty statement says otherwise, the guarantor is:

Warranty claims are submitted via the online service form at www.biall.eu (tab “Service”). In special cases claims may be made by phone to the service department.

Warranty duration is specified in the warranty document supplied with the product; consumables are excluded. The Customer must deliver defective goods to the place indicated in the warranty; shipping is at the Seller’s cost. Warranty does not limit rights under statutory warranty.


§ 10 Seller’s liability

To the extent permitted by mandatory law, for Customers who are not consumers the Seller’s liability is limited to actual losses (not lost profits) and may not exceed the Product Price.


§ 11 Personal data protection

The Seller is the Data Controller.

By registering, the Customer consents to collection and processing of personal data for contract performance (Personal Data Protection Act 29 August 1997). Data may be disclosed to entities through which the Seller fulfils the Order.

Providing: first name, surname, e‑mail, street, building/flat number, postcode, city, country, phone number is necessary to process the Order.

By registering or subscribing to the newsletter the Customer consents to processing data for advertising, market research and behaviour analysis to improve services. The Customer has the right to access, correct and request deletion of data. The Controller ensures data security and will not knowingly disclose data to third parties.


§ 12 Commercial information

The Customer may consent to receive advertising and commercial information (offers, news, promotions) by e‑mail. Consent is optional and can be withdrawn via the link in each e‑mail or in the “newsletter” tab at www.biall.eu.


§ 13 Final provisions

The Regulations enter into force on the date of publication on the Store’s website.

Any amendments take effect upon publication and apply prospectively; they shall not infringe Customers’ rights arising from Orders placed before the amendments.
